a. that Regulation of the Minister of Agriculture No. 89/Permentan/OT.140/12/2011 concerning Amendment to the Regulation of the Minister of Agriculture No. 37/Kpts/HK.060/1/2006 concerning Technical Requirements and Plant Quarantine Action for the Entry Fresh Fruits And Or Vegetables Into Territory of the Republic of Indonesia already stipulated places for the entry of fresh fruits and or vegetables into Territory of the Republic of Indonesia;
b. that regulations in the Free Trade Zones and Free Ports governed function of free ports to support activities of Free Trade zone;
c. that for enforcement of Regulation of the Minister of Agriculture No. 89/Permentan/OT.140/12/2011 needs preparation of structure, infrastructure, human resources, in government environment, business entrepreneurs, or trading partners;
d. that based on considerations above, and while waiting preparation of structure, infrastructure, human resources, in government environment, business entrepreneurs, or trading partner, it is necessary to postpone enforcement of Regulation of the Minister of Agriculture No. 89/Permentan/OT.140/12/2011 and opens free ports as the entry places of fresh fruits and or vegetables into Territory of the Republic of Indonesia;

REGULATION OF THE MINISTER OF AGRICULTURE CONCERNING AMENDMENT TO THE REGULATION OF THE MINISTER OF AGRICULTURE No. 89/Permentan/OT.140/12/2012 CONCERNING AMENDMENT TO THE REGULATION OF THE MINISTER OF AGRICULTURE No. 37/Kpts/HK.060/1/2006 CONCERNING TECHNICAL REQUIREMENTS AND PLANT QUARANTINE ACTION FOR THE ENTRY OF FRESH FRUITS AND/OR VEGETABLES INTO TERRITORY OF THE REPUBLIC OF INDONESIA
To amend Article I in Regulation of the Minister of Agriculture No. 89/Permentan/OT.140/12/2011 concerning Amendment to the Regulation of the Minister of Agriculture No. 37/Kpts/HK.060/1/2006 concerning Technical Requirements and Plant Quarantine Action for the Entry Fresh Fruits And Or Vegetables Into Territory of the Republic of Indonesia:
1. Provision of Article 17 shall be amended, so it is read as follows:
"Article 17
(1) Entry places of fresh fruits and vegetables as intended in Article 4 paragraph b, are:
(2) Beside entry places as intended in paragraph (1), entry places are determined as free ports based on regulations in the field of free trade zones and free ports can be used as entry places of fresh fruits and/or vegetables.
(3) The purpose for the entry of fresh fruits and/or vegetables through entry places as intended in paragraph (2) in accordance with regulations in the field of free trade zones and free ports."
2. To postpone enforcement of Regulation of the Minister of Agriculture No. 89/Permentan/OT.140/12/2011 from March 19, 2012 become from June 19, 2012.
This Ministerial Regulation shall comes info force on the date of promulgation.
For public cognizance, this Regulation of the Minister of Agriculture shall be promulgated by placing it in the State Gazette of the Republic of Indonesia.
